For Texas-based owner-finance lenders, navigating through these regulations can present uncertainty at every turn. A <em><u>few<\/u><\/em> examples of confusion include:<\/span><\/p>\n<ul>\n<li><span style=\"font-size: 20px;\">\u201cAs a lender, what regulations apply to me and what regulations am I exempt from because I am a \u201csmall servicer\u201d (\u00a71026.41(e)(4))?\u201d<\/span><\/li>\n<li><span style=\"font-size: 20px;\">\u201cMy borrower won\u2019t send updated proof of insurance. I want them to pay for it but I remember hearing something about \u201cforce-placed insurance notices?\u201d<\/span><\/li>\n<li><span style=\"font-size: 20px;\">\u201cMy borrower hasn\u2019t made this month\u2019s payment. I don\u2019t know whether to start the foreclosure process\u2026and what\u2019s this I\u2019ve heard about some \u201c120-day Rule?\u201d<\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 20px;\">Without a doubt, there is a lot to wade through when it comes to residential mortgage servicing. Federally, the CFPB has implemented a series of Dodd-Frank amendments to RESPA (Regulation X) and TILA (Regulation Z). At the state level, the Texas Department of Savings and Mortgage Lending monitors Texas-based residential mortgage servicers acting under the guidelines of the Texas Administrative Code.<\/span><\/p>\n<p><span style=\"font-size: 20px;\">The founders of DIA Servicing understand that Texas owner-finance lenders did not go through the trouble to originate, document, and close the owner-finance loan correctly on the front-end, only to settle for subpar, non-compliant note servicing on the back-end during the life of the loan. As such, every action taken by our team now and forever in the future, will be guided by all applicable rules and regulations. We have a responsibility to both lenders and borrowers. To lenders, aside from efficient monthly payment servicing, we have a responsibility to protect their interest in the loan and to avoid jeopardizing the long-term returns.
